Registration requirements and notices: key rules to remember

Our summary of what the official handbook says on this topic, in our own words. Read it before or after the practice questions above, then check the original chapter. Read the official chapter ↗

Applying and conditions

  • Individual applicant: Individual applicants must be at least 18 and resident in Canada; individual registrants must remain resident in Canada.
  • Prior debts: Applicants must not owe TICO money or have an unpaid TICO judgment, and must have repaid any Fund claims caused by a past failure, unless acceptable arrangements are made; interested persons must meet the same conditions.
  • Registration expiry: Registration expires on the date shown on the certificate.
  • Reapplication: After a refusal, revocation or refusal to renew, a person may reapply only after 30 days and only with new evidence or materially changed circumstances (Act s. 14; Reg s. 7).

Grounds to refuse

  • Refusal grounds: Refusal if the applicant cannot reasonably be expected to be financially responsible, past conduct suggests it will not carry on business lawfully with integrity and honesty, or a false statement is made in the application (for individuals and corporations, including interested persons).

Proposals and suspension

  • Proposal hearing: The registrar gives written notice of a proposal to refuse, suspend, revoke, add unconsented conditions or refuse a branch office; the person has 15 days to request a Licence Appeal Tribunal hearing, otherwise the registrar may carry it out.
  • Temporary suspension: In the public interest the registrar may order an immediate temporary suspension; if a hearing is requested it expires 15 days after the Tribunal receives the request unless the Tribunal extends it.

Corporate changes

  • Corporate changes: A change of officers or directors of a registered corporation needs the registrar's consent; a change of partners creates a new partnership for registration.

Security for new applicants

  • New applicant security: Unless a statutory exemption applies, a person not registered during the previous 12 months provides $10,000 security. After two consecutive annual filings it is returned within a reasonable time if compliance concerns are resolved, less paid or anticipated attributable Fund claims.

Name, premises, certificate

  • Business names: Business only under the registered name or a Business Names Act name notified to and acknowledged by the registrar; no name implying a sponsorship, approval or affiliation it lacks.
  • Home office: Business in Ontario only from a permanent place of business in Ontario; a home office needs municipal zoning permission, a listed business phone number separate from the home number, and arrangements for access to records.
  • Branch office: Branch offices must be authorized by the registration.
  • Registration certificate: The certificate is kept at the office it was issued for and shown on request; it is returned promptly by registered mail or personal delivery if registration is revoked, suspended or cancelled or the business closes.

Notices

  • Advance notice: At least five days' advance notice to the registrar of a change of office or branch address, of the person managing an office (or immediately if unforeseen), or of bank account name, number or institution.
  • Other changes: Other changes to application information: within five days after.
  • Business closure: Ceasing to sell travel services: written notice at least 10 days before if known, otherwise as soon as practicable, plus a letter with the date and where records will be kept.
  • Unregistered counterparty: Registrants must not do business with anyone who is required to be registered but is not.
  • Financial concern notice: A registrant that stops trading with another registrant because of apparent financial irresponsibility must promptly tell the registrar in writing.
