What applies if a registrant wants a second trust account?
- It needs the registrar's written consent in advance
- It must close its operating account first
- It needs the consent of every customer
- It may open as many as it likes without telling anyone
Show answer and explanation

Official reference ↗A registrant does not qualify for the specified government-funded non-profit exemption. What working-capital rule applies?
- Liabilities may exceed assets for up to six months
- Current assets must be greater than current liabilities
- Total assets must exceed $1 million at all times
- Cash on hand must equal one month of sales
Show answer and explanation
Correct answer: Current assets must be greater than current liabilities
Section 24 requires current assets to exceed current liabilities under generally accepted accounting principles, excluding the section 25 security and capital of interested persons. The regulation contains a specific exemption for qualifying government-funded tourism non-profits, so the rule should not be presented as exception-free.

Official reference ↗An agency follows the section 27 trust-account model. How must it hold customer money received for travel services?
- In the owner's personal savings account until the day of departure
- In cash in a locked safe at the agency's office
- In any business account, mixed with operating funds
- In trust, in a designated Travel Industry Act trust account
Show answer and explanation
Correct answer: In trust, in a designated Travel Industry Act trust account
Under section 27, qualifying money actually received from customers is held in trust in an account designated as a Travel Industry Act trust account. Section 28 provides a distinct security alternative for qualifying established registrants; this is not permission to mix trust receipts with operating money.

Financial documents
- Annual documents: Every registrant files financial documents each fiscal year; the type depends on sales in Ontario (smaller registrants may file a verification statement or financial statements; larger ones file annual financial statements, and the largest also file other documents).
Working capital
- Working capital: A registrant must keep current assets greater than current liabilities, calculated under GAAP, excluding security provided to TICO and capital belonging to interested persons (tourism-promotion not-for-profits with government funding agreements can be exempt).
Bank accounts
- Bank accounts: All accounts in Ontario at a Schedule I or II bank, loan or trust corporation or credit union, in a name the registrant may use for business; payments for travel services are deposited promptly.
Trust accounts
- Trust model: Under the s. 27 trust-account model, qualifying money actually received for travel services is held in a designated Travel Industry Act trust account. Section 26.1 defines receipts; section 28 provides a distinct security alternative for qualifying established registrants.
- Deposit deadline: Customer money is deposited within two banking days after it is received.
- Extra trust accounts: Only one such trust account without the registrar's written consent in advance; a copy of the trust agreement (and any changes) goes to the registrar within five days.
- Permitted withdrawals: Trust money may be paid out only to pay the supplier of the travel services, to refund a customer, or — after the supplier has been paid in full — to pay the registrant's commission.
Security instead of trust account
- Security alternative: A registrant in continuous business for at least one fiscal year may instead give TICO security of at least one-sixth of the customer money it received for travel services over the 12 months shown in its latest financial documents.
- Acknowledgement: The trust account obligation continues until the registrar acknowledges the security; the amount is reviewed within 30 days after each financial filing deadline.
Business records
- Record contents: Accounting records with supporting documents (including uniquely numbered invoices), banking records, a record of all payments tied to transactions by unique identifier, and the files kept under ss. 39 and 40.
- Retention: Kept at the principal place of business (or another place approved in writing) for at least six years after the transaction.
