Answer before opening the key. After a mistake, identify the missed condition and return to its topic and official source. This is a study exercise, not material authorized for use in the official exam.

The six online sets cover the bank without overlap. Simulator draws and this sheet reuse those concepts; they do not create extra independent questions or predict success.

For a shorter mobile session, choose a 27-question set instead. The result identifies missed answers and topics to revisit. Use the official links to locate the actual rule and its exceptions; a real transaction may involve additional facts beyond the study scenario.

Answer key with explanations

  1. 1. C — Up to two years

Section 37 prescribes up to two years of advertising pre-approval under MVDA section 29. The period follows the applicable unappealed or Tribunal-upheld order process; it is not an automatic two-year restriction on every advertiser.

    OMVIC, the MVDA and its regulations · Based on: O. Reg. 333/08, s. 37; MVDA s. 29(4)–(5); checked 2026-10-24

  2. 2. C — 90 days or 5,000 km, whichever comes first

Section 63 covers new or reconditioned installed parts and installation labour for at least 90 days or 5,000 km, whichever occurs first. Misuse/abuse concerns the affected part, and a repairer needs reasonable grounds before refusing reimbursement on that basis. It does not automatically void every unrelated repair warranty.

Consumer Protection Act and repairs · Based on: Consumer Protection Act, 2002, s. 63(1), (5)–(6); checked 2026-10-24

  3. 3. A — The recorded odometer reading and the credit given

Trade-in details include the owner, VIN, make, model, year, trim, colour, body type, recorded odometer reading, the credit allowed, a statement from the customer on the s. 42 disclosure items and any agreement to pay off a loan. Resale plans and original price are not required.

    Contract requirements · Based on: O. Reg. 333/08, s. 43(4); checked 2026-10-24

  4. 4. A — Registered dealers, or equivalent registrants located in another jurisdiction at sale

Section 2(3), paragraph 7 permits registered dealers and persons located in another jurisdiction at sale who hold equivalent registration there. The exemption has other ownership, access, identification, disclosure and record conditions. Retail auctions under section 46 are a separate setting.

    CAMVAP, consignment, plates, auctions and branding · Based on: O. Reg. 333/08, s. 2(1), para. 1; s. 2(3), especially para. 7; checked 2026-10-24

  5. 5. C — Leave them with the dealer unless a lawful, authorized transfer is arranged

Access for work does not automatically authorize copying customer information for a new employer or a new purpose. Personal-information use and disclosure must respect applicable consent and lawful exceptions. Calling the information someone’s property does not remove the customer’s privacy rights.

  6. 6. B — The truck must be fit for that stated purpose

Section 15(1) concerns a disclosed particular purpose, reliance on the seller’s skill/judgment and goods of a kind the seller supplies. In that stated scenario, reasonable fitness for that purpose is implied. Merely mentioning a use without those conditions is not enough to establish the same conclusion in every sale.

Researching vehicles and the Sale of Goods Act · Based on: Sale of Goods Act, s. 15, para. 1; checked 2026-10-24

  7. 7. A — 59,200 km

A distance is deemed accurate if within the lesser of 5 per cent or 1,000 km. For 60,000 km, 5 per cent is 3,000 km, so the 1,000 km limit applies: only readings from 59,000 to 61,000 km count, so 59,200 km is the one that qualifies.

  8. 8. D — The appeals committee established under section 17

A party may appeal a final discipline order to the appeals committee under section 17(5). Under section 17(6), it may overturn, affirm or modify the order and make an authorized discipline order. This question identifies that statutory appeal route; it does not rule out every possible judicial-review remedy.

Inspections, curbsiders and the Code of Ethics · Based on: Motor Vehicle Dealers Act, 2002, s. 17(2), (5)–(6); checked 2026-10-24

  9. 9. C — Not driveable, not certified, and the price of certification if offered

OMVIC’s unfit-vehicle guidance calls for a clear not-driveable/not-certified disclosure and the certification price if offered. That certification charge cannot be mandatory. Other intended mandatory fees remain in the advertised price.

  10. 10. D — Licensed-insurer protection or the prescribed irrevocable letter of credit

Section 47(1) requires performance insurance from an insurer licensed under the Insurance Act or the prescribed irrevocable letter of credit to the Fund’s trustee. If the warranty seller goes out of business, a facilitating dealer can be liable for a covered claim amount not paid from that security under section 47(3). This is not a promise that every warranty claim is payable by the Fund.

  11. 11. C — A qualifying dealer-only auction with no property interest in vehicles

The auction exemption requires the conditions in section 2(3), including no auctioneer property interest and eligible dealer buyers, with access and record requirements. It is not a blanket exemption for every business called an auction, broker or exporter.

    Registering dealers and salespeople · Based on: O. Reg. 333/08, s. 2(1), para. 1; s. 2(3); checked 2026-10-24

  12. 12. D — Sale of the leased vehicle to its existing lessee

The fee was already paid when the vehicle was leased, so a sale to the lessee during or at the end of the lease is exempt, as is a sale to another registered dealer. As-is, fleet and demonstrator deals all attract the fee.

OMVIC, the MVDA and its regulations · Based on: OMVIC — Transaction Fees, Exempt transactions; checked 2026-10-24

  13. 13. C — Yes, a court can consider oral statements made during the deal

CPA section 18(10) allows oral evidence about an unfair practice despite a written agreement and despite whether the representation appears in it. Admissibility is not an automatic finding that every alleged promise was made or breached. Section 11 separately resolves qualifying ambiguity to the consumer’s benefit.
