Front and back of each card, as in the deck above. The cards come from our own notes on the official handbook; check anything you are unsure of with Vehicle Sales Authority of British Columbia (VSA).
  1. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

Which body administers the Motor Dealer Act for vehicle sales to consumers in BC?

The Motor Dealer Council of BC, operating as the Vehicle Sales Authority (VSA), administers the Motor Dealer Act through the registrar. ICBC handles vehicle insurance and registration, and the other bodies regulate other industries.

  2. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

Under the Motor Dealer Act’s motor-dealer definition, what is the primary purpose of the recipient’s vehicle use?

The definition covers business activity disposing of vehicles to another person primarily for personal, family or household purposes, including holding out, advertising and promotion. This question concerns that definition, not a claim that all commercial or wholesale activity is unregulated under every law.

  3. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

Subject to a regulatory exemption, what volume of the defined dealer activities triggers the Act’s deemed-dealer rule?

Section 1(2) deems a person a dealer when they carry on the defined activities for five or more vehicles in a 12-month period, subject to exemption. The ordinary business-activity definition can apply below five; four sales are not an automatic safe harbour.

  4. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

Which of these is a motor vehicle under the Motor Dealer Act?

Motor vehicles include self-propelled highway vehicles and trailers designed for accommodation during travel or recreation. ATVs, farm tractors and construction machinery are excluded.

  5. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

Which vehicle does the regulation exclude from the definition of motor vehicle?

The regulation excludes boat trailers, utility trailers with a gross vehicle weight rating of 1,400 kg or less, and golf carts. Motorcycles, pickups and motorhomes are motor vehicles.

  6. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

Which organization is exempt from the Motor Dealer Act?

ICBC and insurers licensed under the Insurance Act are exempt from the Act. Businesses that sell vehicles to consumers, including RV and motorcycle dealers, must be registered.

  7. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

Which person is NOT treated as a motor dealer when disposing of a vehicle?

Section 14(4)(b) exempts the person for vehicle dealings in the course of specified estate, court or insolvency duties. It is not a general exemption for all the person’s unrelated business. Other sellers must be assessed against the actual business-activity definition and any applicable exemption.

  8. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

A company buys ten pickups exclusively for its commercial fleet. Does that purpose meet the Act’s primarily personal/family/household dealer-sale definition?

The stated exclusive business use does not satisfy the primarily personal, family or household purpose in the motor-dealer definition. Other obligations or remedies may apply; this does not mean commercial vehicles or wholesale businesses are exempt from every law.

  9. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

Which consigned vehicle can fall within the Act’s definition of a dealer’s inventory?

The inventory definition includes vehicles the dealer is authorized to sell under a consignment agreement complying with the Motor Dealer Consignment Sales Regulation. A dealer need not own every qualifying consigned vehicle, but possession or advertising alone does not establish the required authority.

  10. The VSA, the Motor Dealer Act and who is regulated · The VSA, the Motor Dealer Act and who is regulated

What may the registrar publish about an administrative penalty?

The registrar may publish enforcement actions, including penalties, with the person's name, the penalty amount and the reason or nature of the contravention.

FAQ

BC VSA Salesperson flashcards: questions

Where do these flashcards come from?

Each of the 144 cards is one point from our study notes, which we write from the official Motor Dealer Act Regulation (B.C. Reg. 447/78) and related VSA legislation. The front names the rule; the back states it. Nothing on the cards is added beyond those notes.

How should I use the flashcards?

Read the front, answer in your head, then flip. Choose "Got it" only if you knew it; otherwise choose "Review again". At the end, go through the "Review again" cards once more, or pick a single topic from the list to focus on it.

Is my progress saved?

Yes, on this device only. Cards marked "Review again" stay in the "Needs review" list, and every card you rate counts towards your topic map on the exam overview. Nothing is sent to us with your name; you can clear it from the overview page.

Are flashcards enough to pass the BC VSA Salesperson test?

No. Flashcards help you remember the rules, but the test asks multiple-choice questions. Use our practice tests and mock exams as well, and study the official material from Vehicle Sales Authority of British Columbia (VSA).
